1. Prices
The prices of the currently valid price list apply. We reserve the right to correct calculation and calculation errors. Package offers are only valid for a short period of time for a specific order.
2. Orders
Orders are generally executed in the way they are ordered by telephone, in writing or by telex. Orders of all types must clearly identify the subject matter of the transaction. Changes, confirmations, or repetitions must be marked as such. If orders are carried out for the benefit of a third party, the corresponding remuneration must be paid by the client in case of doubt. Verbal agreements require (remote) written confirmation.
2.1 Order changes
The driver is only authorized to make changes to the scope of the order to the extent that:
a) These are discussed with QualityLine Limousine and Chauffeur Service
b) these do not exceed the usual length of a chauffeur trip
In the event of inability or impossibility, liability for damages and/or performance is excluded. This applies even if the journey cannot be carried out due to unexpected damage to the vehicle. QualityLine Limousine and Chauffeur Service will then endeavour to procure a replacement. If this is not possible, QualityLine Limousine and Chauffeur Service may withdraw from the contract.
3. Compensation
Payment is due at the end of the order. If invoicing has been agreed, the due date occurs upon receipt of the invoice. At the time of default, interest is calculated in the amount of 4% above the Bundesbank discount rate (Section 288 BGB; Section 352 HGB). If the customer is in default, a collection agency is commissioned, the customer must bear the resulting costs. A fee of 5€ or more may be charged for each reminder. For orders over 5,000€, QualityLine is entitled to demand up to 50% of the order value before it starts.
4. Withdrawal
Costs incurred in the event of cancellation may be charged, even if the trip is not started. The compensation is based on the price list or, as a lump sum, according to the following model:
Bus rental:
a) Up to 15 days in advance: 10%
b) 14—5 days before: 25%
c) From 4 days in advance: 50%
d) From 2 days before or no show: 100%
Car rental:
a) Up to 2 days in advance: 20%
b) 1 day before: 30%
c) Up to 12 hours in advance: 70% (airport/city transfer: 20%)
d) Within 12 hours or no show: 100%
Chauffeur rental:
a) Up to 2 days in advance: 25%
b) 1 day before: 80%
c) Within 1 day or no show: 100%
For large orders, the full amount may be due after order confirmation. At least 3 or 8 hours must be paid after departure, depending on the type of trip.
5. Prohibited use
Vehicles may not be used:
a) For the transport of dangerous substances
b) To commit crimes
c) For improper trips
Instructing the driver to make such uses is also prohibited.6. Liability of the customer
a) The customer is personally and indefinitely liable for culpably caused damage
b) The same applies to prohibited use
c) Statutory regulations remain unaffected Damages due to communication errors are borne by the customer unless QualityLine is responsible.
7. QualityLine's liability
Liability only in case of gross negligence, and only as part of motor liability insurance. Third parties who act on behalf are only liable if selected and instructed. Damage to customer vehicles caused by drivers is excluded.
8. Compensation claims
Payment is only made after inspection and verification of the file. For other claims, only against a valid invoice in accordance with § 259 BGB.
9. Reservation of amendment
If the ordered vehicle is not available, an equivalent vehicle will be provided whenever possible.
10. Data storage
The customer agrees to the storage of his data by QualityLine for corporate purposes.
11. Jurisdiction
The place of jurisdiction is Viersen if:
a) the customer is a registered trader
b) he is not domiciled in Germany
c) he moves abroad
d) his place of residence is unknown
12. Salvatory clause
Should parts of these terms and conditions be invalid, the rest remains effective. The legal regulations then apply.
